Welcome to DAKAEi.MA. These Terms and Conditions ("Terms") govern your access to and use of DAKAEi.MA, including our website, mobile applications, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

DAKAEi.MA is operated by DAKAEi Technologies LTD ("DAKAEi", "we", "us", "our").

2. Eligibility and accounts

You must be at least 13 years old to use the Service.
You are responsible for:

  • providing accurate account information,

  • maintaining the security of your account credentials,

  • all activity under your account.

You must notify us immediately if you believe your account has been compromised.

3. Description of the Service

DAKAEi.MA provides AI-powered features, including (depending on your plan and eligibility) chat, voice, translation, image generation, trip planning, tourist tools, and related utilities.

Some features may be changed, paused, limited, or discontinued at any time.

4. Acceptable use

You agree not to use the Service to:

  • violate any applicable law or regulation,

  • infringe intellectual property or privacy rights,

  • generate or distribute unlawful, abusive, hateful, violent, or fraudulent content,

  • attempt to reverse engineer, disrupt, or abuse the Service,

  • bypass feature limits, credit limits, or security controls,

  • upload or transmit malware, spam, or malicious code.

We may suspend or terminate access for misuse.

5. AI outputs and limitations

The Service uses artificial intelligence and may produce incorrect, incomplete, or inappropriate outputs.
You are responsible for reviewing outputs before relying on them.

DAKAEi does not guarantee that AI outputs are accurate, complete, or fit for any specific purpose (including legal, medical, financial, or safety-critical decisions).

6. User content

You retain ownership of content you submit ("Input").
Subject to applicable law, you grant DAKAEi a limited license to process Input and generated output solely to provide, secure, and improve the Service.

You are responsible for ensuring you have rights to any content you upload or submit.

7. Plans, credits, subscriptions, and payments

Some features require paid plans, credits, or one-time passes.

  • Prices, limits, and plan features are displayed in-app and may change.

  • Payments are processed by third-party payment processors.

  • You authorize recurring charges for subscription plans until cancelled.

  • Unless required by law, fees are non-refundable after successful service delivery.

  • Credits and promotional allowances may expire or be limited by campaign terms.

  • Abuse of promotional offers may result in removal of eligibility.

8. App Store and platform terms

If you download DAKAEi from app stores, your use is also subject to applicable platform terms (e.g., Apple App Store, Google Play).

9. Privacy

Your use of the Service is also governed by our Privacy Policy available at /privacy.

10. Intellectual property

The Service, including software, branding, design, and non-user content, is owned by DAKAEi or its licensors and protected by intellectual property laws.

You may not copy, sell, license, distribute, or exploit our Service or brand assets without written permission.

11. Third-party services and links

The Service may integrate third-party tools or services. We are not responsible for third-party products, terms, or availability.

12. Service availability

We aim for reliable uptime but do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or emergency changes without notice.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied.

14. Limitation of liability

To the maximum extent permitted by law, DAKAEi and its affiliates, officers, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities.

Our total liability for any claim arising out of or related to the Service is limited to the amount you paid to DAKAEi in the 12 months before the claim, or the minimum amount required by applicable law, whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless DAKAEi from claims, damages, and expenses arising from:

  • your misuse of the Service,

  • your violation of these Terms,

  • your infringement of third-party rights.

16. Suspension and termination

We may suspend or terminate your account if you violate these Terms, misuse the Service, or create risk for users or the platform.

You may stop using the Service at any time and request account deletion via settings or support.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in-app, by email, or by updating the date above. Continued use after updates means you accept the revised Terms.

18. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Morocco, unless mandatory local consumer law provides otherwise.

Any dispute arising out of these Terms shall be subject to the competent courts of Morocco, unless otherwise required by applicable law.
